Republican Senator Tommy Tuberville recently wrote an opinion piece claiming President Joe Biden’s administration wants open borders, so Democrats have an easier time at the ballot box.
The former Auburn coach and current Alabama senator has been vocal on social media about Biden’s policies on the Middle East and the border. Tuberville claimed Biden was lying about not having the authority to shut down the border without congressional approval. Tuberville wrote Biden wants open borders.
Tommy Tuberville thinks Joe Biden has a weak border policy
Tuberville wrote an opinion piece in the Daily Caller to explain why he thinks Democrats are weak on immigration policy. He thinks Democrats benefit from congressional representation where illegal immigrants live:
Under current law and regulation, the apportionment of congressional seats in Congress among the states is decided based on a population number that includes illegal immigrants.
Yes, that’s right. Illegal immigrants impact how congressional representation is decided, even if they don’t vote and aren’t supposed to be here.
It gets worse. This is a presidential election year and, in this country, the President is elected by the Electoral College. These Electoral College votes are based upon congressional seats, which are affected by the tens of millions of illegal immigrants in this country.
Many people have asked me why liberal cities like Boston and Philadelphia have voted for sanctuary policies. They’ve advertised to the whole world that they want illegal immigrants to live there—these cities won’t even help deport convicted criminals. It makes absolutely no sense—except that it gives them more political power in Congress and in the Electoral College.
You don’t have to take my word for it. Democrat Congresswoman Yvette Clarke of New York—a sanctuary state—admitted, “I need more people in my district just for redistricting purposes.”

Tommy Tuberville thinks a solution to the perverse incentive of having illegal immigrants in a district is to pass a law changing how congressional seats are tallied:
That’s why I was proud to join my friend Bill Hagerty, United States Senator for Tennessee, in introducing legislation called the Equal Representation Act. Our bill would put President Trump’s directive into federal law and stop counting illegal immigrants when it comes to determining seats in Congress. We ought to have this bill sitting on President Trump’s desk on his very first day back in office.
Why doesn’t Texas want more seats?
Tuberville’s theory is interesting in big cities. But states near the border, like Texas and Arizona, are trying to curb the border crisis. Texas Gov. Greg Abbott bussed migrants to Chicago and other big cities recently, essentially helping liberal cities receive better representation. (Kind of a policy blowback?)
Texas is currently in a fight with the federal government on policing the border.
Wouldn’t the conservative leaving states of Texas and Arizona stand to gain extra districts and electoral votes by keeping these migrants in their states?
