Next week, a significant event is set to unfold: an NIL roundtable hosted by Texas Senator Ted Cruz. This roundtable, a platform for discussing the hot topic of name, image, and likeness (NIL) in college sports, will feature the likes of former legendary football coach Nick Saban and the Cavinder twins, among others. Cruz, a Republican, is proposing a policy that would restrict states from enacting laws on compensation, employment status, athlete eligibility, or NIL, as reported by On3’s Pete Nakos.

Five other notable figures will join the Cavinder twins and seven-time college football champion Nick Saban on the panel. Kansas senator and Republican Jerry Moran, ACC Commissioner Jim Phillips, Alabama Crimson Tide athletic director Greg Byrne, The Collective Association’s president Russell White, and NIL attorney Darren Heitner will all contribute their unique perspectives on the current state of college athletics, with a specific focus on NIL.

The Cavinder twins, who gained fame as social media stars while playing on the Miami Hurricanes women’s basketball team, are no strangers to the world of NIL, having secured multiple sponsorships. Saban, one of the most decorated college coaches of all time, has been vocal about the impact of the name, imagine, and likeness era in collegiate sports, even citing it as a reason for his retirement at the end of the 2023 season. The other guests all have a direct connection to a university or NIL, except for Moran.
The NCAA and newly enacted president Charlie Baker continues to lobby Congress for rules and guidelines surrounding NIL. Meanwhile, the NCAA is currently in a legal battle (Johnson v. NCAA) to determine whether student-athletes are covered by the Fair Labor Standards Act, which requires them to be paid a minimum wage, like their peers in work-study programs.
NIL Roundtable: On Heels of Dartmouth Unionization
On Tuesday, the Dartmouth men’s basketball team voted to form a union. While they still need to win the appeal process, the debate between athletes and employees rages. Ted Cruz’s roundtable will also happen on the same day as the subcommittee of the House of Education and the Workforce Committee hosts a hearing titled “Safeguarding student-athletes from NLRB (National Labor Relations Board) misclassification. In 2022, the National College Players Association filed “unfair labor practice charges” with the NLRB against UCLA, USC, it’s governing conference and the NCAA. Again, the players sought the employee role and, in doing so, a heightened floor on compensation.
